The information contained in this report was accurate at the time of printing. However, for the most up-to-date information, interested persons should contact the Board office. Additionally, the description of the licensee’s conduct is general in nature and anyone interested in a complete description of the licensee’s conduct should request that documentation from the Board office.
Zhivko N. Daskalov, M.D., Kansas City, MO
Cause of Discipline: 334.100.2(4)(g) & (5), RSMo
The Board found cause to discipline license based upon the denial of Licensee’s application for hospital privileges. In its report of the denial, the hospital cited continued practice below the standard of care due to Licensee’s failure to prescribe medications upon discharge, pending a follow-up visit. In addition, the hospital cited Licensee’s repeated failure to make progress visits to hospitalized patients.
Board Action: License is placed on Probation for a period of two (2) years. During Probation, Licensee is restricted from engaging in a solo practice of medicine. Within thirty (30) days of effective date of agreement, Licensee shall submit a plan of practice limited to a supervised, structured environment.

The Board found cause to discipline license based upon Licensee’s failure to maintain records of controlled substance prescriptions and his failure to maintain an annual inventory of controlled substances.
Board Action: License is Publicly Reprimanded. Licensee must obtain six (6) hours of continuing medical education in medical record keeping or compliance within nine (9) months from date of this agreement. These hours shall be in addition to the number of hours required for licensure renewal.

The Board found cause to discipline license based upon Licensee’s failure to complete both a prescribing course and a record keeping course within six (6) months of April 15, 2003, the effective date of the Settlement Agreement.
Board Action: License is Suspended for a period ofthree (3) years or until the Board receives a fit-to-practice letter from Rush Behavioral Health Center and proof of completion of Board-approved prescribing and record keeping courses. The Suspension shall be immediately followed by Probation for a period of five (5) years.

The Board found cause to discipline license based upon Licensee’s conviction of the felony offense of Conspiracy to Distribute and Dispense More than 30,000 Units of Lortab (hydrocodone) Outside the Scope of Professional Practice.
Board Action: License is Revoked with no application for reinstatement for a period of seven (7) years.

The Board found cause to discipline license based upon Licensee’s guilty plea to the felony offenses of First Degree Deviate Sexual Intercourse with a Person Less Than Fourteen (14) Years Old, Second Degree Sodomy, Abuse of a Child and First Degree Endangering the Welfare of a Child.
Board Action: License is Revoked with no application for reinstatement for a period of seven (7) years.

Cause of Discipline: 334.100.2(1),(4)(i), RSMo
The Board found cause to discipline license based upon the summary suspension of Licensee’s privileges at Missouri Delta Medical Center. Suspension was due to allegations of assault against Licensee’s spouse following Licensee’s consumption of alcohol, and also due to allegations of sexual misconduct involving Licensee and a patient.
Board Action: License is Publicly Reprimanded. In addition, license is Suspended for a period of one (1) year, to be followed by Probation for a period of seven (7) years. Due to the fact that Licensee sought treatment, period of suspension shall be deemed to have commenced six (6) months prior to the effective date of this Agreement.

The Board found cause to discipline license based upon Licensee's guilty plea in the Circuit Court of Cedar County, Missouri, to the Class C felony of possession of hydrocodone, a controlled substance.
Board Action: License is revoked. Licensee may not reapply for licensure until such time as he obtains a passing score of seventy-five (75) on the SPEX.

The Board found cause to discipline license based upon conduct by Licensee that is or might be harmful or dangerous to the mental or physical health of a patient.
Board Action: License is Publicly Reprimanded and placed on Probation for a period of two (2) years. Licensee shall have a qualified physician(s) assist in, and/or observe all major OB/GYN surgeries until thirty (30) surgeries are completed.

The Board found cause to discipline license based upon Licensee’s failure to properly document controlled substances prescribed. Licensee also engaged in conduct or practices potentially harmful or dangerous to the mental or physical health of patients and failed to use the degree of skill and learning ordinarily used under the same or similar circumstances by members of the profession.
Board Action: License is placed on Probation for a period of three (3) years. Licensee shall not reapply for BNDD or DEA registration without prior written consent of the Board.

The AHC found cause to discipline license based upon the Joint Stipulation entered by the parties whereby Licensee acknowledged violations of state and federal drug laws, rules and regulations.
Board Action: License is Publicly Reprimanded. Licensee must also complete a Board-approved record keeping course and a Board-approved prescribing course within six (6) months of the effective date of this Order.

The Board found cause to discipline license based upon Licensee's violation of the terms of the Settlement Agreement, as amended. Under the terms of the Agreement, as amended, Licensee was not permitted to prescribe Schedule II controlled substances. Licensee prescribed demerol and morphine to a patient, which was a violation of Missouri law and regulations.
Board Action: License is Publicly Reprimanded. Licensee must, within thirty days, submit a written policy for handling of controlled substances that complies with BNDD and DEA regulations. Such policy shall include a requirement that twenty percent of cases requiring handling of controlled substances be audited by the hospital's credentialing committee and a quarterly report be submitted to the Board. Policy shall be signed by Licensee, consulting physician and hospital administrator.

The Board found sufficient cause to hold a disciplinary hearing based upon Licensee’s alleged unprofessional conduct in that Licensee submitted an Alternative Report in response to a Board subpoena that was not a true and accurate reflection of the medical care provided to the patient in question. Parties agreed that neither the agreed to facts or the conclusions of law shall be construed that Dr. Ellis knowingly made, or caused to be made, the Alternative Report.
Board Action: Respondent Voluntarily Retired his Missouri
