DISCIPLINARY ACTIONS SINCE
SPRING 2002 NEWSLETTER
Publication of all disciplinary actions by the Board is required by law
and is available on a quarterly basis, whether there is a printing of the
newsletter or not. The information contained in this report was accurate at the
time of printing. However, for the most up-to-date information,
interested persons should contact the Board office. Additionally, the
description of the licensee's conduct is general in nature and anyone
interested in a complete description of the licensee's conduct should request
that documentation from the Board office.
Ricardo M. Kennedy, M. D., St. Louis, Missouri Cause of Discipline:
§334.100.2( 2) and (4)
(g), RSMo 2000 The Board ordered license issued on proba-tion
based upon Licensee's consumption of alcohol and subsequent arrest and
conviction for sexual bat-tery
in 1995 in California. Licensee served sixty (60) days in the county jail, sixty
(60) days home arrest,
sixty (60) days community service and five (5) years probation. Licensee also
completed a six (6) month
in-patient alcohol rehabilitation program. Board Action: License issued on
Probation
for the duration of temporary license, not to exceed ten (10) years.

Eugene G. Zuzga, D. O., Clinton, Michigan Cause of Discipline:
§334.100.2( 8) RSMo
Supp. 1999 The Board and Licensee entered into a Set-tlement
Agreement whereby Licensee will voluntarily surrender his license to practice
medicine in the
State of Missouri. Pursuant to a Consent Order and Stipulation entered with the
Michigan Board of Os-teopathic
Medicine, Licensee Voluntarily Surren-dered his license to practice medicine in
Michigan.
Board Action: License is voluntarily surren-dered.

§334.100.2( 4)( a) and
(14), RSMo 2000 The Board found cause to discipline license
based upon Licensee's provision of fraudulent work excuses with no physical
examination performed or
medical history obtained on the patients. Licensee was paid $20.00 for each such
fraudulent work ex-cuse.

RSMo 1999 The Administrative Hearing Commission found
cause to discipline license based upon Licensee's prescribing or refilling
medications before previous
supply had expired which was or might be harmful to the patient. Also, Licensee
altered medical records
without indicating they were altered, which conduct is unethical or
unprofessional.
Board Action: License is placed on Probation for a period of two (2) years.

Hugh L. Lacey, M. D., Springfield, Missouri Cause of Discipline:
§334.103, RSMo
The Board found cause to discipline license based upon Licensee's failure to
have a female li-censed
health professional present for the duration of all female patient visits, which
violates the terms of
Licensee's settlement agreement entered effective April 17, 2001.
Board Action: License continues on Probation under same terms and conditions
except disciplinary
period is amended to commence retroactively from September 26, 2001, for seven
(7) years.
Effective Date: 4-23-02 Licensee filed an appeal of the Board's order
with Cole County Circuit Court on May 9, 2002.

§345.065.2( 3), (6) and
(11), RSMo 2000 The Board found cause to discipline license
based upon Licensee's failure to obtain and submit proof of continuing
education, and the falsification of
his renewal application wherein he indicated comple-
tion of the requirements. Board Action: License placed on Probation for
a period of two (2) years with requirements for addi-tional CE's.

based upon Suspension of license by the Arkansas State Medical Board for a

as long as Licen-see
adheres to the terms of the Arkansas Order and this Settlement Agreement.

1994 The Board found cause to discipline license
based upon Licensee entering into a Stipulation with the department of
Professional Regulation of the
State of Illinois. The State of Illinois reprimanded li-cense, alleging gross
negligence resulting in addi-tional
surgery on the patient. Board Action: License is Publicly Repri-manded.

Medicine due to her failure to practice medicine with a level of care, skill and
treatment recognized by a pru-dent
similar physician as being acceptable under similar conditions and
circumstances.
Board Action: License is Publicly Repri-manded. Licensee must also provide proof
of atten-dance,
and completion of, the Florida continuing medical education course on emergent
cardiac treat-ment
within thirty (30) days of completion. Effective Date: 6-10-02

The Board found cause to discipline license based upon Licensee's personal use
of methamphet-amine
which impaired her ability to perform the duties of a physician.
Board Action: Temporary license issued on Probation for five (5) years, or the
duration of the
temporary license, whichever period is less. Effective date: 7-13-02
Martin McDonald, D. O., Wappapello, Missouri Cause of Discipline:
§334.100.2( 23), RSMo
Supp. 1999 The Board found cause to discipline license
based upon Licensee's Settlement Agreement with BNDD which placed his BNDD
registration on proba-tion
for a period of five (5) years and which consti-tutes a limitation or
restriction of his Missouri Con-trolled
Substance authority. Board Action: License is placed on Probation
for a period of seven (7) years. Effective date: 7-26-02
William R. Bonner, D. O., Stockton, Missouri Cause of Discipline:
§334.103, RSMo
The Board found cause to discipline license based upon Licensee's plea of guilty
to possession of
hydrocodone, a class C felony. Board Action: License is Revoked with no
ap-plication
for reinstatement for a period of two (2) years and one (1) day.
Effective Date: 7-22-02 Appeal of the Board's disciplinary order was
filed on August 20, 2002, in the Circuit Court of Cedar County, Missouri. Stay
of enforcement of the Board's
order effective August 20, 2002.
Taiyong Chung, M. D., Poplar Bluff, Missouri Cause of Discipline:
§334.100.2( 4), (5) and
(25), RSMo 2000 The Board found cause to discipline license
based upon Licensee's treatment of a patient which was harmful and dangerous to
a patient's physical
health and constitutes incompetence and gross negli-gence in the functions and
duties of a physician.
Board Action: License is Permanently Limited in that licensee may not perform
general surgery.
Effective Date: 6-24-02
Cesar Maldonado, M. D., El Paso, Texas Cause of Discipline: §334.100.2(
1) and (8),
RSMo The Board found cause to discipline license
based upon disciplinary action taken against his li-cense to practice medicine
in Texas due to alcohol
abuse. Board Action: License is placed on Probation
for a period of five (5) years, retroactive to September 7, 2001.

The Board found cause to discipline license based upon Licensee issuing "sick
slips" to patients
without performing a proper medical examination. Licensee accepted a fee for
each such sick slip is-sued
to the patients. Board Action: License is Publicly Repri-manded.

§334.100.2( 13) and
(23), RSMo The Administrative Hearing Commission
found cause to discipline license based upon Licen-see's allowing distribution
of controlled substances
by a physician not appropriately registered to dis-pense such drugs, and also
the fact that her DEA
Certificate of Registration was Voluntarily Surren-dered.
Board Action: License is placed on Probation for a period of three (3) years,
retroactive to the date
of Probation ordered by the Missouri Bureau of Nar-cotics and Dangerous Drugs.

The Board found cause to discipline license based upon Licensee's failure to
comply with statu-tory
requirements governing the dispensing of con-trolled substance by physicians.

George David Schmutz, P. T., Warsaw, Missouri Cause of Discipline:
§334.100.2( 4)( o), RSMo
The Board found cause to discipline license based upon Licensee testing positive
for marijuana,
in violation of his probation agreement with the Board.
Board Action: License is Suspended for a period of three (3) years, or until he
provides docu-mentation
from MAOPS stating he is fit to return to
practice. At that time, license will be issued on Pro-bation for a period of
seven (7) years.

Coleen O. Carroll, P. T., St. Louis, Missouri Cause of Discipline:
§334.100.2( 4)( a), RSMo
The Board found cause to discipline license based upon the fact that Licensee
submitted patient
visit reports for billing purposes for patients whom she did not see on the
dates documented.
Board Action: License is Publicly Repri-manded. Licensee also required to attend
and com-plete
an ethics course to be approved by the Board prior to attendance.

§334.100.2 (4)( o), RSMo
The Board found cause to discipline license based upon Licensee's consumption of
alcohol, in
violation of his November 5, 1999, Settlement Agreement.
Board Action: License is Suspended for a period of three (3) years, retroactive
to June 11,
2001. Following period of Suspension, license shall be reinstated on Probation
for a period of ten (10)
years. Effective Date: 8-19-02
Gina McCrary Smith, D. O., St. Louis, Missouri Cause of Discipline:
§334.100.2( 6), RSMo
The Board found cause to discipline license based upon Licensee's failure to
submit documenta-tion
of required continuing medical education (CME) hours, failure to respond to the
Board's inquiries re-garding
CME's, failure to retain documentation of at-tendance and completion of CME's
and failure to ob-tain
the required twenty-five (25) hours of CME's for the period January 1, 2000,
through December 31,
2000. Board Action: License is Publicly Repri-manded.
Licensee must also, within six (6) months, complete fifty (50) CME hours in
addition to the re-quired
CME's for January 1, 2002, through Decem-ber 31, 2003.

medicine in the State of
Missouri for a period of one-hundred eighty (180) days from the date of the
Injunction, or until such
time as cases against Licensee pending in Jasper County Circuit Court are
resolved.

(11), RSMo 2000 The Board found cause to discipline license
based upon Licensee's failure to obtain continuing education hours from an
approved entity as defined

After the Board amended the order of disci-pline after eliminating
prescribing authority, Licen-see
filed a Motion to Dismiss his Request for Re-view of Administrative Proceedings
previously filed
in the Circuit Court of Howell County. Dismissal of the case ordered by the
Court. Stay of the Board's
Order of March 10, 2002, is dissolved. Board Action: Board's Order reinstated
as
of date of dismissal by Howell County Circuit Court. Effective Date: 8-8-02
