Publication of all disciplinary actions by the Board is required by law and is available on a quarterly basis, whether there is a printing of the
newsletter or not. The information contained in this report was accurate at the time of printing. However, for the most up-to-date information,
interested persons should contact the Board office. Additionally, the description of the licensee's conduct is general in nature and anyone
interested in a complete description of the licensee's conduct should request that documentation from the Board office.
 

Richard C. Shaw, M. D., St. Louis, MO Cause of Discipline: 334.100.2( 4), (5) and (13),
RSMo Hearing Before the Administrative Hearing Com-mission, and Consent Order With Joint Proposed Findings of Fact and Conclusions of Law wherein Licensee admitted to issuing prescriptions for Schedule II controlled sub-stances for a patient but failed to document the prescriptions in the patient's record.

Board Action: License is placed on Probation for a period of five (5) years from the effective date of this Order.
Effective Date: 10/ 30/ 2003

 
Chester R. Badger Jr., D. O., Kansas City, MO
Cause of Discipline: 334.100.2( 4) (o) RSMo
The Board found cause to discipline license based upon Licensee's violation of the Settlement Agreement entered into with the Board effective 12-17-01. Li-censee possessed, controlled and consumed hydrocodone and lidocaine and failed to timely notify the Board of the prescriptions, all in violation of the Settlement Agree-ment.
 

Board Action : License is placed on Probation for a period of seven (7) years from the effective date of this Order. Terms and conditions of the 12-17-01 settlement agreement remain in full force and effect.

Gina McCrary Smith, D. O., St. Louis, MO Cause of Discipline: 334.100.2( 4) (o), RSMo
The Board found cause to discipline license based upon Licensee's failure to complete an additional fifty (50) hours of CME's within the six (6) month period as set out in the Settlement Agreement of August 21, 2002.
Board Action: License is placed on Probation for a period of three (3) years.

Robert W. Reid, M. D., Overland Park, KS Cause of Discipline: 334.100.2( 3), (6), (8) and
(11), RSMo The Administrative Hearing Commission found
cause for the Board to discipline license based upon the Joint Stipulation filed wherein licensee acknowledged limitations
placed on his license by the Kansas Board of Heal-ing Arts. The Kansas order placed limitations on his con-trolled
substance privileges and medical license due to Licensee's chemical dependency and unprofessional con-duct
due to impairment. Board Action: License is placed on Probation for
a period of five (5) years from effective date of this order. Licensee is mandated to participate in either MPHP or
MAOPS for the duration of the Probationary period. Effective Date: 01/ 12/ 2004
 

Faiz Ahmed, M. D., Houston, TX Cause of Discipline: 334. 100.2( 8) RSMo
The Board found cause to discipline license based upon a Joint Stipulation between Licensee and the
Board. Licensee and the Board entered into a Settlement Agreement wherein Licensee acknowledged action taken
against his license by the Texas Board of Medical Examiners due to discipline of his hospital privileges based
upon allegations of inappropriate examinations of female patients.
Board Action: License is Suspended, Suspension stayed. License placed on Probation for a period of ten
(10) years from the effective date of the Settlement Agreement.

Ralph A. Ford, M. D., Licking, MO
Cause of Discipline: 334.100.2( 5) RSMo
The Board found cause to discipline license based upon Licensee's failure to use that degree of skill
and learning ordinarily used under the same or similar circumstances by other members of his profession. Licensee's
failure to perform necessary standard tests upon patient's initial hospital admission constitutes incompetency
and gross negligence in the performance of Licensee's duties.
Board Action: License is Publicly Reprimanded. Licensee must also, within twelve (12) months of date of
this agreement, complete twenty-five (25) hours of CME on the topic of chest pain. These hours shall be in addition
to those required for license renewal. Effective Date: 01/ 28/ 2004
 

Richard D. Zujko, M. D., Liberal, KS Cause of Discipline: 334.100.2( 5), (8) and (25),
RSMo The Board and Licensee entered into a Settlement
Agreement wherein Licensee elected not to contest or dispute the Board's factual allegations of multiple deviations
from standard of care, multiple adverse medical li-ability claim settlements and repeated acts of negligence.
Licensee admitted his license was suspended in Kansas and that he is currently not capable of practicing medicine
with reasonable skill and safety.
 
Board Action: License is Revoked. Licensee may not apply for reinstatement of his medical license
for a period of seven (7) years. Effective Date: 02/ 02/ 2004
 

Steven M. Abbadessa, D. O., St. Louis, MO Cause of Discipline: 334.100.2 (22) RSMo
The Board found cause to discipline license based upon Licensee's pattern of personal use or consumption
of a controlled substance not prescribed, dispensed or administered by another physician authorized
by law to prescribe such controlled substances. Board Action: License is placed on Probation
for a period of seven (7) years. Effective Date: 02/ 09/ 2004
 

Joel H. Rubin, D. O., Flower Mound, TX Cause of Discipline: 334.100.2 (8) RSMo
The Board found cause to discipline license based upon action taken against Licensee by the Texas
State Board of Medical Examiners. The Texas Order was based upon a finding that Licensee failed to practice
medicine in an acceptable professional manner consistent with public health and welfare.
Board Action: License is Publicly Reprimanded. Licensee must also obtain at least fifty (50) hours of
Category 1 CME per year for two (2) years. Effective Date: 02/ 18/ 2004
 

John M. Navarro, M. D., Oklahoma City, OK Cause of Discipline: 334.100.2( 4), (5), (13) and
(14), RSMo The Board found cause to discipline license
based upon the fact that Licensee misappropriated remifentanil and falsified records to indicate that the drug
was discarded or that Licensee administered more remifentanil than he actually had. Licensee failed to document
the administration of remifentanil to patients, instructed a subordinate not to document the remifentanil,
failed to obtain DHSS registration, failed to complete an order for the remifentanil and dispensed controlled sub-stances
not in good faith. Board Action: License is Suspended for a period
of three (3) years or until evaluated by Rush Behav-ioral Center and issued a "fit to practice" letter from
Rush. Period of Suspension to be followed by Probation for a period of five (5) years. On March 24, 2004, Settlement
Agreement was amended to terminate the period of Suspension and reinstate Licensee under terms
of Probation. Effective Date: 02/ 20/ 2004
 

Bruce N. Parsa, D. O., Leawood, KS Cause of Discipline: 334.103, RSMo 2000
The Board found cause to discipline license based upon Licensee entering a plea of guilty to a felony
count of conspiracy to distribute or dispense Schedule II controlled substances.
Board Action: License is Revoked. Licensee may not apply for reinstatement for a period of five (5)
years. Effective Date: 02/ 24/ 2004
 

Dalrie Berg, D. O., Thornton, CO Cause of Discipline: 334.103, RSMo 2000
The Board found cause to discipline license based upon action taken against Licensee by the Colorado
State Board of Medical Examiners (Colorado Board). The Colorado Board revoked license to practice
medicine in the State of Colorado due to Licensee's un-professional conduct, acts or omissions which failed to
meet generally accepted standards of practice and failing to make essential entries in patient records.
Board Action: License is Revoked. Effective Date: 02/ 24/ 2004
 

Eric D. Jorgensen, M. D., St. Joseph, MO Cause of Discipline: 334.103, RSMo 2000
The Board found cause to discipline license based upon Licensee's plea of guilty, in the Circuit Court
of Buchanan County, Missouri, to a Class C felony of possession of a controlled substance.
Board Action: License is Revoked. Licensee may not apply for reinstatement for a period of three (3)
years, or until completion of court ordered Probation. Effective Date: 02/ 24/ 2004
 

Nolan Crisp, M. D., Bolivar, MO Cause of Discipline: 334. 100. 2 (23) RSMo
2000 The Board found cause to discipline license
based upon a finding by the Administrative Hearing Commission, that Licensee is subject to discipline due
to his entering into a Joint Stipulation with BNDD on or about May 18, 2001.
Board Action: License is placed on Probation for a period of three (3) years, retroactive to November
27, 2002. Effective Date: 03/ 02/ 2004
 

Charles Sutherland, D. O., Paris, MO Cause of Discipline: 334.100.2( 4) (o), RSMo
The Board found cause to discipline license based upon Licensee's plea of guilty to charges of driving
while intoxicated, in violation of the Board's 1997 disciplinary order.
Board Action: License is placed on Probation for a period of ten (10) years from the effective date of
this Order. In addition, Licensee shall notify the Board within twenty-four (24) hours of discontinuing his prescriptions
of Antabuse and/ or Altrexone. Effective Date: 03/ 04/ 2004
 

David L Harmon, D. O., Overland Park, KS Cause of Discipline: 334. 100. 2 (4) (8) RSMo
2000 The Board found cause to discipline license
based upon Licensee entering into an Agreed Order of Probation with the Kentucky Board of Medical Licensure
for a period of twenty-four (24) months. The Kentucky Board found proof that Licensee engaged in dishonorable,
unethical or unprofessional conduct of a character likely to deceive, defraud, or harm the public.
Board Action: License is placed on Probation for a period of two (2) years. Licensee shall have a female
staff member (chaperon) present on all occasions where an adult female parent or guardian is present, regardless of whether juvenile patient is present. Patient record shall identify the chaperon who is present on each and every occasion and chaperon shall counter-sign the record next to the identification.

Grant Bever, M. D., St. Louis, MO
Cause of Discipline: 334.100.2( 4) (g) and (5),
RSMo The Board and Licensee entered into a Joint
Stipulation and Consent Order wherein all parties agreed that Licensee will permanently and voluntarily
agree to limit his practice of medicine to gynecological services of the nature and type that would be rendered
in a general family practice setting. Further, Licensee agrees that gynecological services that require hospitali-zation
or other than routine office procedures, will not be undertaken by him unless and until he provides the
Board with proof of appropriate malpractice insurance and hospital privileges.
Board Action: License is placed on Probation for a period of two (2) years from the effective date of
this agreement. Licensee is permanently Restricted from practicing Obstetrics.
Effective Date: 03/ 11/ 2004
MISCELLANEOUS ACTIONS
Robb R. Hicks, M. D., Cape Girardeau, MO
License was suspended for a period of three (3)
years effective August 19, 2002, retroactive to June 11, 2001. Licensee formally requested that the Board terminate
the period of suspension. Board Action: Suspension of license terminated.
All other terms of the Board's Order of August 19, 2002 shall remain in full force and effect.
Effective Date: 12/ 01/ 2003
Robert P. Smith, M. D., Poplar Bluff, MO
Licensee made formal request to the Board for
amendment of existing Settlement Agreement to allow him to make application to BNDD for Schedule II con-trolled
substance prescribing authority. Board Action: Settlement Agreement is
amended to approve Licensee's request that his Schedule II prescribing authority be reinstated, restricted to
hospital settings only. Effective Date: 02/ 27/ 2004
 

Joseph S. Richmond, M. D., Minneapolis, MN Licensee made formal request to the Board that
the requirements of the Order of Probated License be amended to eliminate requirements that Licensee participate
in, and be monitored by, The Mississippi Recov-ering Physicians Program and MPHP.
Board Action: Order is amended to terminate the requirement that Licensee participate in, and be
monitored by the Mississippi Recovering Physicians Program and MPHP.

Donald DePriest, SLP, Springfield, MO Cause of Discipline: 334.100.2( 4)( o), RSMo
The Board found cause to discipline license due to Licensee's failure to renew his speech-language pa-thology
license for the period January 1, 2003 through December 31, 2005. In addition Licensee failed to ob-tain
the required continuing education units for the period January 1, 2001 to December 31, 2002.
Board Action: License is retired in lieu of discipline.

James T. Birch, M. D., Kansas City, MO
Cause of Discipline: 334.100.1 and .2( 1), (4)
(g),( 8), (13), (22) and (23) RSMo The Board found cause to deny licensure based
upon applicant's previous substance abuse and discipline of his license by the Virginia Board of Medicine.
Board Action: License issued on Probation in lieu of denial of permanent license. License to remain
on Probation for a period of five (5) years from effective date of this Order.

Scott Allen Gutshall, PT, Florissant, MO
Cause of Discipline: 334.540.3, RSMo
The Board found cause for denial of license based upon information received from the Federation of
State Boards of Physical Therapy indicating that applicant had failed to pass the physical therapist licensing
examination on three (3) attempts. Board Action: Licensure denied. Applicant ap-pealed
Board's decision to the Administrative Hearing Commission. On March 24, 2004, the Administrative
Hearing Commission affirmed the Board's denial of li-censure.

Devashish Sen, M. D., Boston, MA
Cause of Discipline: 334.100.1 and 334. 100. 2
(1), (4)( g), RSMo The Board found cause to deny license based
upon revocation of license by the Massachusetts Board of Registration in Medicine, and the Missouri Board of
Healing Arts, and indefinite suspension by the Illinois Department of Professional Regulation. Action was
taken due to Licensee's misappropriation and use of Demerol and Fentanyl while on duty.
Board Action: License issued under terms of Probation for a period of five (5) years.

Irwin Estrine, D. O., Warren, MI
Cause of Discipline: 334.100.2 (8) RSMo
The Board found cause to discipline license based upon an Order issued by the Michigan Board reprimanding
license and assessing a fine of $7, 500 against Licensee. The Michigan Order cited negligence
and conduct, practice or condition which impairs, or may impair, the ability to safely and skillfully practice medicine.
 

Board Action: License is Voluntarily Retired in lieu of discipline.

Amanda K. Eakin, AT, Poplar Bluff, MO Cause of Discipline: 334.715.1 (1) RSMo
The Board found cause to discipline registration based upon the fact that applicant had been employed as
an athletic trainer from approximately June 2000 through approximately March 27, 2003, without obtaining a registration
to practice. Board Action: Registration is issued on Probation
for a period of one (1) year in lieu of denial of registration. Effective Date: 02/ 01/ 2004
 

Gregory Kellogg, PT, Springfield, MO Cause of Discipline: 334.100.2 (6), RSMo 2000
The Board and Licensee mutually agreed and stipulate that Licensee failed to respond to the Board's re-quest
for proof of completion of thirty (30) hours of con-tinuing education. Licensee provided proof of completion
of twenty-eight (28) hours of CE but failed to provide proof of completion of the remaining two (2) hours.
Board Action: License is Voluntarily Surrendered. Effective Date: 02/ 04/ 2004
